These Booking Terms & Conditions (“Booking Terms”) apply when you make a booking through the Shorely Ibiza mobile apps operated by SHORELY LTD (Shorely™, trading as Shorely Ibiza) (“Shorely”). You must accept these Booking Terms before payment is taken.
Bookings are not made on the website. The website hosts these terms for reference and for links from the app.
1. Booking model
- SHORELY LTD acts as commercial agent for the Spanish venue.
- The contract for the service is between you and the venue.
- Bookings and payments are completed in the Shorely mobile apps only.
- Shorely may collect a booking fee, deposit, and/or prepayment depending on the resource and partnership tier.
- Where commission applies between Shorely and the venue, it is accounted for in the venue payout and is not a separate guest line item unless disclosed at checkout.
2. Information before payment
Before you pay, the app will show (as applicable):
- Total price including fees and taxes shown at checkout
- Identity of the service provider (the venue)
- Characteristics of the booking (what, when, party size)
- The cancellation / refund policy that applies to that booking
- Acknowledgement that placing the booking creates a binding contract
3. Fees and payments
- Booking fee — a platform fee charged to you and retained by Shorely where applicable.
- Deposit / prepayment — amounts collected toward the venue service, as shown for the resource.
- Cancellation / no-show fees — charged under the venue policy shown at checkout, when applicable.
- Payments are processed by Stripe. Shorely does not store full card numbers.
4. Right of withdrawal
EU consumer law gives consumers a 14-day right of withdrawal for many distance contracts. That right is excluded for contracts for leisure and catering services that are supplied on a specific date or during a specific period — which is what you book through Shorely: a table, sunbed, daybed, bed, cabana, VIP area, or dated experience, reserved for a stated date and time.
The exclusion is set out in Article 16(l) of the Consumer Rights Directive (2011/83/EU) and, in Spain, in article 103(l) of the consumer code (Real Decreto Legislativo 1/2007). It applies whether you book tomorrow or six months ahead — it depends on the nature of the service, not on how far in advance you book.
What governs your cancellation instead: the cancellation policy shown for your specific booking, which you accept at checkout and which is set out in section 5 below. That policy is the whole of your right to cancel and be refunded, alongside your non-excludable rights if the service is not supplied as described.
Ferry tickets are passenger transport and sit outside the Consumer Rights Directive altogether (Article 3(3)(k)). Ferry cancellations are governed by the operator’s fare conditions shown before you pay.
5. Cancellation and refunds
Each booking shows a specific cancellation policy (resolved from seasonal, resource, area, or venue rules, or Shorely’s default). Typical presets include:

- Shorely enforces the policy shown for your booking (including charging a cancellation fee via Stripe when applicable).
- Valid refunds are returned to the original payment method within approximately 5–10 business days.
- After the free-cancel window, Shorely’s earned booking fee is generally non-refundable on guest-initiated cancels, unless the venue cancels or fails to deliver.
6. No-shows
If you do not attend, no refund is due unless the venue policy for that booking provides one. No-show fees may apply as shown at checkout.
7. Venue cancellations
If the venue cancels a confirmed booking, you receive a full refund including applicable fees. Shorely will attempt to notify you as soon as practicable.
8. Disputes with venues
Disputes about service quality are between you and the venue. Shorely may assist as a mediator but is not a party to that dispute and is not liable for venue conduct, without prejudice to mandatory consumer rights.
